A common misconception is that a person is automatically guilty simply because drugs are found in his car. That fact, in and of itself, does not equal guilt. The government must also prove intent or knowledge to possess.

Possession of Marijuana is by far the most common drug charge in South Texas. “POM” is prohibited by both federal and state laws. Different factors determine what charge will be filed. Factors include weight of the marijuana, location, and the person’s criminal record. Numerous other factors can affect sentencing.

South Texas is well-known for its heavy drug presence. Consequently, many government agencies have large numbers of agents. Kingsville recently became home to a large base for the U.S. Border Patrol, but there are many agencies.

A partial list of agencies seeking drug arrests in South Texas include the U.S. Border Patrol, Drug Enforcement Administration, U.S. Customs Service, Texas Department of Public Safety, several narcotics ‘task forces’, every county’s sheriff and constables, and municipal police departments.

The hypocrisy inherent in the “War on Drugs” is appalling. Government devotes billions of dollars to capture and prosecute the small fish, doing little to nothing to slow the drug trade.

If you’ve been arrested, you’re likely a “little fish”, and I think that is worthy of being defended. Contact me when you find yourself in a bind.
